AAT/ MRT Appeals

If an application for visa to stay in Australia is declined or a visa to stay in Australia got cancelled, immigration allows applicant submit an administration appeal tribunal(AAT) for a merit review of this decision. Application for merit review of this decision must be given to the AAT within 21 calendar days after the day on which visa decline received. Applicant may only seek merits review of the decision with the AAT if you are physically present in Australia at the time the application for merits review is made.

Immigration status during AAT:

During the processing of your visa application, generally a bridging visa is granted to you for the duration of the visa processing period. When you make a valid application for merits review of this refusal decision then that bridging visa will remain in effect during the merits review proceedings. In some cases applicants need to apply for a new Bridging Visa.

Waiver Request

Waiver request is for a person who gets a notice of No further stay in Australia.Applicant is not allowed to submit any visa application onshore by holding this condition. In case of current visa extension or new visa application an applicant can submit a condition waver to immigration requesting to wave 8503 condition. It is recommended to submit your waive request before your current visa expires. In case you’re No Further stay in Australia is waived, then you can apply for another Visa without leaving Australia.
